FTC to Delay Enforcement of Red Flags Rule until November 1, 2009

Just announced, the Federal Trade Commission (“FTC”) has suspended enforcement of the Red Flags Rule for a third time, resulting in a new compliance date of November 1, 2009, which is an additional three month delay from the most recent compliance date of August 1, 2009 (see May 1, 2009 edition of the WER). WAPA May Join LS Power as Partner to 500 kV Idaho-Nevada Line

On July 16, 2009, the Western Area Power Administration (“WAPA”) and an LS Power affiliate, Great Basin Transmission LLC (“Great Basin”), announced that they have entered into a memorandum of understanding (“MOU”) where WAPA may partner with Great Basin to develop the Southwest Intertie Project (“SWIP”). While the MOU will not affect Great Basin’s current open season for SWIP, a partnership with WAPA could allow construction to start while arrangements for the sale of capacity to third-party shippers are being negotiated. NASUCA Recommends New RTO/ISO Governing Structures

On June 19, 2009, the National Association of State Utility Consumer Advocates (“NASUCA”) released a report that recommended changes to the governing structures of regional transmission organizations (“RTOs”) and independent system operators (“ISOs”). Kelliher Accepts Position at FPL

On Thursday, FPL Group, Inc. (“FPL”) announced that former FERC Chairman Joseph T. Kelliher will serve as the company’s Executive Vice President, Federal Regulatory Affairs. The newly created position will have Kelliher oversee all of FPL’s federal energy regulatory policy matters. Kelliher will report directly to FPL’s Chairman and CEO. [Read more →]

The United States and Mexico Announce Plans to Work Together on Clean Energy and Climate Change

On April 16, 2009, President Barack Obama and President Felipe Calderon announced that the U.S. and Mexico would strengthen cooperation to achieve a low carbon future and promote clean energy resources by establishing the U.S.-Mexico Bilateral Framework on Clean Energy and Climate Change (“Framework”). Both Presidents agreed that the two nations need to work together to obtain the common goal of addressing global warming. [Read more →]
